Following the controversy surrounding Kyle Roche, the lawyer and founder of the legal firm Roche Freedman LLP, the two crypto exchange firms Bittrex and Poloniex want the law firm removed from the class action against them. Like the attorney representing Tether, the attorneys representing Bittrex and Poloniex claim that “Mr. Roche’s recent statements raise serious concerns.”
Poloniex, Bittrex lawyers want Roche Freedman LLP removed from a lawsuit against the exchanges
Bittrex and Poloniex want law firm Roche Freedman LLP removed from a specific class action lawsuit against them. The cryptoboutique lawsuit firm filed a class-action lawsuit against several trading platforms in 2020, and the lawsuit alleges that a number of centralized exchanges used tether (USDT) to manipulate crypto prices.
However, Kyle Roche, an attorney and founder of Roche Freedman, has recused himself from the lawsuits, after a series of videos was published by Crypto Leaks. In the video clips, Roche discusses his relationship with various crypto companies.
The lawyer claims the clips contain “numerous false false statements and illegally obtained, highly edited video clips that are not presented with accurate context.” Despite Roche’s defense, he decided to withdraw from several high-profile cryptocurrency lawsuits.
Immediately after Roche removed himself from the lawsuits, Tether’s attorney Elliot Greenfield of Debevoise & Plimpton LLP asked that Roche’s entire firm be barred from the lawsuit. Now Poloniex and Bittrex are asking for the same, and they believe Roche’s statements and integrity could influence actions like the intent behind the discovery.
“MR. Roche’s recent statements raise serious concerns about the intent behind such discovery and how it will be used,” the exchange’s attorneys wrote to the presiding judge of the Southern District of New York. The filing adds:
Although the exchange defendants appreciate that a protective order has been entered in this case and that counsel can be expected to comply with such orders, Mr. Roche’s statements make it clear that he has already used confidential material produced in litigation for improper purposes.
Meanwhile, Roche Freedman believes the allegations against Kyle Roche are “provably false,” and the law firm says it expected the defendants to exploit the controversy against the entire law firm. “However, it is no surprise that defendants are using it as a litigation tactic to disqualify the entire firm,” Roche Freedman said.
